Peran, Fungsi dan Keberadaan Notaris Indonesia Oleh: Herlien Budiono*)
Peran notaris sejalan dengan politik hukum pemerintah di dalam pembuatan akta berkaitan dengan pendirian perusahan, peraturan dalam rangka pemenuhan Ease of Doing Business di Indonesia.
Civil Law dan Common Law
Di bidang hukum privat materiil dikenal dua sistem hukum besar yakni hukum dari Romawi dan hukum dari Inggris atau para ahli hukum menyebutnya sebagai Civil Law (kadang Roman Civil Law) dan Common Law. Kebudayaan yuridis dari daratan Eropa Barat(seperti Perancis, Belanda, Jerman, Italia, Spanyol, Portugis, Yunani, beserta negara di Asia dan Afrika yang pernah dijajah atau menjadi koloninya seperti Indonesia, Vietnam, Kamboja, Congo) dikuasai oleh kitab undang-undang atau Corpus Iuris Civilis.
Daratan Eropa dan sebagian koloninya dikuasai oleh tradisi hukum Romawi, sedangkan Inggris dan koloninya (serta negara lain seperti Irlandia, Australia, Selandia Baru, Canada kecuali Quebec, Amerika Serikat, beberapa negara Asia dan Afrika yang pernah menjadi koloninya seperti, Malaysia, Singapura) dikuasai oleh tradisi Common Law didasarkan pada kebiasaan yang berasal dari putusan hakim dan merupakan dasar dikembangkannya hukum.
Akta notaris sebagai alat bukti yang terkuat
Sistem pembuktian di Indonesia dengan alat-alat bukti yang berjenjang (Pasal 1866 Kitab Undang-undang Hukum Perdata = KUHPerd) terdiri atas:
- Bukti tulisan yang dilakukan dengan akta autentik maupun dengan akta di bawah tangan;
- Bukti dengan saksi-saksi; – Persangkaan; – Pengakuan; – Sumpah.
Ketentuan Pasal 1868 KUHPerd merupakan landasan mengapa pejabat umum diperlukan, yaitu notaris yang berwenang untuk membuat akta autentik. Akta autentik adalah akta yang di dalam bentuk ditentukan oleh undang-undang, dibuat oleh atau di hadapan pejabat umum yang berkuasa untuk itu di tempat di mana akta dibuatnya.
Tugas jabatan notaris diatur di Undang-Undang Republik Indonesia Nomor 30 Tahun 2004 tentang Jabatan Notaris yang telah diubah dengan Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 tentang Perubahan atas Undang-Undang Republik Indonesia Nomor 30 Tahun 2004 tentang Jabatan Notaris (kedua nya disebut UUJN).
Akta autentik sebagai alat bukti terkuat, salinan dan Grosse akte demikian pula adanya undang-undang kenotariatan sebagaimana dikenal di negara Latin tidak dikenal di negara-negara Common Law. Para notaris yang merupakan ahli hukum di negara-negara Civil Law menyebut dirinya Civil Law Notary sedangkan sebutan Notary Public untuk notaris dengan sistem Common Law.
Peran dan fungsi notaris
Notaris mempunyai peran yang sangat penting di Indonesia sebagai negara penganut sistem hukum Civil Law untuk melayani masyarakat dalam hal pembuatan akta autentik sebagai alat bukti atau sebagai syarat sah/mutlak untuk perbuatan hukum tertentu. Prinsip-prinsip kenotariatan yang menjadi ciri dari notaris Latin adalah pejabat umum yang diangkat negara, berwenang membuat akta autentik yang menjalankan jabatannya dengan mandiri (independent) dan tidak berpihak (impartial) serta merahasiakan isi akta dan keterangan yang diperoleh. Notaris menjalankan jabatan dan menjaga sikap, tingkah laku sesuai dengan peraturan perundang-undangan dan Kode Etik Notaris.
Fungsi notaris tidak sebatas membuat akta autentik tetapi dengan dasar dan alasan filosofis, sosiologis dan yuridis maka notaris dapat mendeteksi kemungkinan iktikad buruk dan akibat yang tidak diinginkan serta melindungi pihak-pihak lemah kedudukan sosial ekonomi dan yuridis dengan demikian melindungi pihak ketiga yang beriktikad baik. Notaris menjamin kecakapan serta kewenangan dari para pihak untuk melakukan tindakan hukum di dalam akta yang dibuatnya.
Politik hukum pemerintah tentang akta notaris
Pembuat undang-undang demi keadilan preventif menentukan keharusan untuk perbuatan hukum tertentu dilakukan dengan akta autentik. Alasan tersebut didasarkan dan berkaitan dengan:
- Perlindungan terhadap pihak yang ”lemah” kedudukan hukumnya karena keadaan sosial ekonominya, setelah mendengar penjelasan notaris agar mereka berhati-hati;
- Katergori kedua berkaitan dengan bentuk perjanjian yakni tindakan hukum oleh pembuat undang-undang dianggap sangat penting;
- Kategori ketiga berkaitan dengan perbuatan hukum yang dilakukan bertentangan dengan undang-undang, kepentingan umum dan kesusilaan yang baik
Perbuatan hukum yang diharuskan dibuat dengan akta autentik, di antaranya akta-akta pendirian Perseroan Terbatas, Pendirian Perseroan Firma dan Perseroan Komanditer, Pendirian Yayasan, Hibah, Pembebanan Jaminan Fidusia, Surat Kuasa Membebankan Hak Tanggungan, Wasiat Terbuka, Wasiat Rahasia.
